The Supreme Court last week exceeded a lower court to facilitate the return of Abrego García. He acknowledged that Abrego García was subject to a 2019 retention order that prohibits his removal from El Salvador, and that the elimination of El Salvador was “therefore illegal.” The court emphasized that the government must facilitate its release from custody in El Salvador and treat its case as if it never deported.

However, Trump’s senior officials said that the decision of the Supreme Court was actually a victory that reaffirmed the president’s broad authority over foreign policy.
