U.K. Supreme Court rules that 2010 equalities law defines a woman as someone born biologically female

London – The UK Supreme Court ruled on Wednesday that a British equal law defines a woman as a biological woman born. Judge Patrick Hodge said that five court judges had unanimously ruled that “the terms ‘women’ and ‘sex’ in the Equality Law refer to a biological woman and biological sex.”

The decision on the interpretation of the 2010 law means a transgender person with a certificate that recognizes them as a woman should not be consulted to a woman for equal purposes under the legislation. But the court added that its ruling “does not eliminate the protection of trans people,” who are “protected from gender reallocation discrimination.”

The voice of the case of a 2018 law approved by the Scottish Parliament that indicates that it should be a 50% female representation in the councils of Scottish public bodies. That law included transgender women in their definition of women.

“A general policy of prohibiting trans women of single -sex services is not a proportional average to achieve a legitimate objective,” said the human rights group.
