The Supreme Court on Thorsday’s day scored the orders approved by the Superior Court of Delhi that ordered the demolition of a Wikipedia page on the basis of a defamation case presented by the news agency, Asia News International (ANI), against incorporated Wikimedia.
A bank of the judges of the Atx Court such as Oka and Ujjal Bhuyan observed that the orders of the Superior Court of April 2 and April 8, approved by a Bank of Judges and Division, respectively, were based on sentences made by ANI that were too broad and unable to be applied.
‘False, misleading and defamatory’
Judge Oka, doors of the hearing, advised the lawyer to ask Ani to return to the Superior Court with a new request that indicates specific content on the page that he considered “false, misleading and defamatory.”
“Back to the Single Judge (of the Superior Court) to make specific sentences that indicate specific portions that will be eliminated from their website … when it says ‘eliminate all false content’, which should be eliminated … who decides what is defamatory.
The lawyer of the news agency said that his client had no objections to the Apex court leaving aside the orders of the Superior Court while granting Liberty to make a new plea for the granting of an interim mandate limited to specific content or republication of the same content.
“This (page) is of a dynamic nature. Each time I (ANI) assault certain statements on the page, new statements or republication of the same statements with a slightly different verbiage can come … change a word or the same content returns,” he returns, “
Consequently, the Bank annulled the orders of the Superior Court and allowed the news agency to submit a new request before a single judge to “grant an appropriate intermediate mandate with respect to the specific content on the petitioner site (Wikimedia.”
The bank asked the single judge, in case an application of this type is made, to decide on their own merits without influence by the order of the APEX court of April 17. The Superior Court left all disputes raised by the parties as the single judge.
The news agency had filed a claim for defamation against the Wikimedia Foundation in the Superior Court of Delhi in July 2024.
