The United States has informed the WTO of the global commercial body that the decision to impose tariffs on steel and aluminum, was based on national security land and should not be considered as safeguard measures, according to communication.
The United States shared this response with the World Trade Organization (WTO) after India requested consultations under the WTO safeguard agreement on April 11 with the United States.
India has said that despite the US characterization of these measures as security measures, they are, in essence, safeguard measures.
He has also declared that the United States has not notified the WTO committee on safeguards under a provision of the agreement on safeguards (years) in decision -a -a -Decision to apply safeguard measures.
“The United States states that the premise for the request for consultations of India under article 12.3 of the Agreement on Safeguardas is that the tariffs are measures of safeguard … the President (USA (USA) imposed the tariffs on steel and aluminum that are made in mind the safety of the US.
The United States also said that section 232 is a National Security Statute, and tariffs remain in place under the security exception allowed under a provision of the General Agreement on Rates and Commerce (GATT) 1994.
He added that tariffs were not imposed under a provision of the 1974 Commerce Law, which is the law under which the United States imposes safeguard measures.
“The United States is not coining these actions in accordance with the safeguards / provision of emergency action … These actions are not safeguard measures and, therefore, there are no basic consultations for the Agreement on Safeguards.”
“Consequently, the request for consultations of India … has no basis on the agreement on safeguard,” he said and, nevertheless, “we are open to discuss this or any other problem with India.”
