A Federal Court of Appeals on Thursday denied the request for an emergency request of the Trump administration to block the order of a judge who demands that the United States government return to Kilmar Abrego García, an illegal immigrant of El Salvador with a gang and a hall and a gang The spokesman and housed. The ruling allows the order of the lower court to advance for now.

The case involves Garcia, a “Maryland man” who was deported but whose performance was ordered by a district judge after a recent decision of the Supreme Court. The Department of Justice (DOJ) requested the United States Court of Appeals for the Fourth Circuit to raise the order of a judge to “facilitate” the return of CECOT, but the Court rejected the request on Thursday.

The three judges panel included Judge Harvie Wilkinson, appointed by President Ronald Reagan, along with Judges Robert King and Stephanie Thakker, appointed by Presidents Clinton and Obama, respectively.

In the Court’s opinion, Wilkinson repeatedly referred to Garcia as a “resident”, even thought that Garcia is not a legal resident of the United States.

“The government is affirming the right to hide residents of this country in foreign prisons without the appearance of due process that is the basis of our constitutional order,” Wilkinson wrote.

“This should be shocking not only for judges, but also for the intuitive sense of freedom that Americans far from court are still loved.”

Judicial documents and police records show that Garcia has a history of domestic violence, including repeated physical abuse against his wife. The National Security Department (DHS) also identified it as a member of the MS-13 gang, using the name of “Chele” street.

The court said that the request of the Department of Justice was “extraordinary and premature” and that would not interfere with the efforts of the district judge to carry out the decision of the Supreme Court.

Attorney General Pam Bondi said that Garcia would not be allowed to return to the United States unless El Salvador decided otherwise. “He will not return to our country.”

The Department of Justice did not immediately respond to the request for comments from Fox News Digital.
