The Idaho judge supervised the case of quadruple murder against Bryan Kherberger asked prosecutors more information about which of the defendant’s relatives plan to call as witnesses, since he considers a defense motion to grant access to the trial to the trial.

Witnesses are generally forbidden to sit in the testimony of other witnesses before they take the position themselves.

While his defending lawyer Elisa Massoth said in court that his family has no interest in cooperating with the State, prosecutors revealed at a hearing last week that they would call “some” relatives as witnesses.

Judge Steven Hipler told prosecutors to present a list of which family members will testify, why they will be called and why they cannot be called just at the beginning of the trial. He said the court would try to find a balance between Kherberger’s right to have supporters present in a public trial and the interests of the prosecutions in which the witnesses were kidnapped.
