Liberal Justice declines to block removal of migrants who claim fleeing cartel

The Judge of the Supreme Court, Elena Kagan, denied on Wednesday an emergency appeal of four Mexican citizens who face deportation. The request asked the Court to temporarily block their removal to be able to present a formal review of review.

Kagan denied the request without comments and did not send the matter to his colleagues in the Court.

The petitioners, Fabian Lagunas Espinoza, Maria Angelica Flores Ulloa and her two children, received the order to inform immigration officials on April 17. His legal team argued that they face poster if they returned to Mexico.

According to its judicial presentation, the family fled from Guerrero, Mexico, in 2021 after being threatened by the Los Rojos cartel. The petition declared that the members of the poster demanded the family vacancy in their home within 24 hours or being killed.

It also included details or violence against members of the extended family, including powers and threats after the negatives to cooperation with the poster.

The family entered the illegal of the United States and sought asylum and an immigration judge denied their claims.

This ruling was confirmed by the Immigration Appeals Board in November 2023, and the Ninth Circuit Court of Appeals affirmed the decision in February 2025. A temporary suspension of elimination was built on April 7.

The emergency appeal before Judge Kagan argued that the lower courts and the immigration authorities did not achieve credible evidence and claims of due process.

According to the procedures of the Supreme Court, each justice manages the emergency appeals of a specific circuit. As the justice assigned to the ninth circuit, Kagan had the authority to act alone or refer to the full court.

She denied the request without referring it more.

In his presentation, the lawyer of the petitioners, Leroy George Siddell, wrote: “The petitioners face imminent elimination and have been ordered to inform the Immigration Office on 04/17/2025, despite the credible and detailed testimony and the documentary evidence that shows that they are the objectives of the poster violence due to their family tits and references to the demands of extinction.”

There was no response from the Department of Justice to the request before Kagan issued his decision.

Until Thursday morning, petitioners had to inform the United States immigration authorities. Your provision remains to be determined.

The Department of Justice did not immediately respond to the request for comments from Fox News Digital.
