Teresa Isabel Bernal, 33, faces a position of lesion for serious crime to a child after several students consumed what officials claim that they were candy with Vodka on December 20 at Jones Elementary School in Tyler.

According to an affidavit obeyed by Ketk, a police officer from the Independent School District of Tyler (ISD) received a phone call from the deputy director of the Jones’ elementary who said he believed that a father had led to a class party.

A child vomited and another could not stop after consuming six shots, according to a trial of the affidavit. The school staff said that the students had consumed almost all the contaminated shots before the staff realized that they contained alcohol.

Fifteen students were sent to the school nurse and reported having stomach pains and headaches, said the affidavit.

After returning from Christmas holidays, another student reported that he had thrown twice at school that day, according to the affidavit, while another student said he had “fainted” after school after the party.

Bernal told the officer that he had bought the gelatin shots of a local business he found on Facebook.

Bernal denied knowing that there was alcohol in the jelly shots and said that he did not intend to give candy to the students.

However, the researchers did not agree with Bernal’s claims, saying that, after looking at the photo of the gelatin shots he ordered, “clearly establishes the gelatin shots contain Smirnoff [a vodka brand]”The complaint says.

“In my opinion, there is no way that Bernal could have lost the fact that the shots of Jello-o that he bought and brought to the fifth grade Christmas party of his daughter contained alcohol drinking,” says the affidavit.
